About the supplier: Endeavour Group Limited ABN 77 159 767 843 operates under South Australian liquor licence 51402336, owns the website and is the supplier of wines via the website.

About these terms and conditions: Use of this website is acceptance of these terms and conditions. If you do not agree to these terms and conditions, do not use this website.

These terms and conditions govern visitors' access to and use of the website, and the supply of products ordered via the website. WineMarket may modify or repeal these terms and conditions without prior notice. In case of a modification or repeal, the pre-existing terms and conditions continue to apply to any products ordered via the website before the change takes effect.

The Website

Intellectual property: Material displayed on the website is subject to copyright owned by WineMarket or its content suppliers and is protected by law. Brands and logos displayed on the website may be the subject of registered trade marks of WineMarket or its product suppliers and protected by law. A visitor to the website may access, display, download and print portions of the website for their own private non-commercial use and to order products via the website, subject to any additional restrictions displayed on the website. Any other use of material on the website is prohibited.


All content included on this site, including but not limited to text, graphics, logos, button icons, images and software is the property of WineMarket or its content suppliers and is protected by the Commonwealth of Australia Copyright Act 1968 and other international copyright laws. This excludes property in which the rights of third parties are expressly identified on this site.

Permission is granted to display and, subject to any expressly established restrictions or limitations relating to specific material, download or print portions of the material from the site solely for your own non-commercial use, or to place an order with Winemarket.

Any improper use, including but not limited to the reproduction, modification, distribution, transmission, re-publication or display of the content on this site is strictly prohibited.

Third-party links: If the website links to another website, WineMarket is not responsible for the content of such other website, nor for any use (or misuse) of information a visitor may supply to that other website, nor for any goods or services on offer at that other website. If a visitor has a problem with a third party website so linked, please notify WineMarket.

Third-party content: If the website displays material sourced from a third party (including a supplier of product, or a consumer of product), WineMarket does not warrant or represent the accuracy, utility or other characteristic of that material.

Visitors' use of the website: A visitor to the website must not post on the website any material that is abusive, defamatory, obscene, contrary to law or to the rights of any party. WineMarket may block / delete from the website any material posted to the website that WineMarket decides contravenes that requirement. A visitor in using the website must not impersonate the identity of another person. A visitor must not attempt to use the website or any of its content to solicit others to participate in any organisation or commercial on-line service. Improper use of the website may result in the visitor being banned from the website, being liable to WineMarket for breach of contract and / or infringe applicable law.

Indemnity: A visitor agrees to indemnify, defend, and hold harmless each of WineMarket, its officers, employees, agents, licensors and suppliers from and against all losses, expenses, damages and costs resulting from any violation of these terms and conditions or any activity related to the visitor's account (including negligent or wrongful conduct) by the visitor or any other person accessing the website using the visitor's Internet account.

Website functionality: WineMarket does not represent or warrant that the functions within the website would be uninterrupted or error-free, that any defects would be corrected, or that the website or the server that makes the website available is free of viruses or other harmful elements.

Password security: A visitor to the website allocated a password is responsible to prevent the password being disclosed to any third party.

Privacy: Our Privacy Policy is available on the WineMarket site: https://www.winemarket.com.au/privacy-policy and forms part of these terms and conditions. You acknowledge and agree to the terms of our Privacy Policy.

Receiving Commercial Electronic Messages: You agree that we may send you commercial electronic messages and tailored advertising (which include marketing communications advertising goods and services) via various channels and media (including by email, SMS, phone and mail) where you have not opted out (as described below) from receiving such electronic messages sent to you by WineMarket via those channels or media. Your agreement to receive commercial electronic messages from us will be effective until you opt out.

You may opt out of the receipt of commercial electronic messages, by using the unsubscribe facility in the footer of any commercial electronic message. If you tell us you opt out of the receipt of such material, you will only receive information we are required by law to provide to you or factual information directly about your account, including changes to these terms and conditions and/or the Privacy Policy, Account transactions or other important information relating to products you have purchased.

Opting out of receiving commercial electronic messages from WineMarket will not withdraw your consent to receive messages from other Endeavour brands. Any consent you have provided to receive commercial electronic messages from other Endeavour brands are governed under separate terms and conditions that apply to those other Endeavour brands. If you would like to opt out of other Endeavour brands, please follow the opt out facilities in their communications or other opt out options set out in their terms and conditions.

Supply of Products

Buyers: To buy wine via the website, the buyer must be at least 18 years of age, be located within Australia and specify a delivery address within Australia.

Under law, alcoholic beverages can only be sold or supplied to persons aged 18 years of age or over, who are not intoxicated. By placing an order, the buyer confirms they are at least 18 years of age. If buying wine as a gift, the recipient must also be at least 18 years of age. The courier will request some form of ID if there is any doubt about the age of the recipient on delivery. If that recipient is unable to produce appropriate ID, the courier cannot leave the wine.

Due to tax purposes, WineMarket can not supply to any business intending to on-sell their products.

Special offers: At any time, WineMarket may terminate any special offer without advance notice.

Vouchers: Each promotional voucher may only be redeemed once per household. Vouchers may not be redeemed on Champagne and non wine items such as beer, cider and spirits. Vouchers may not be used in conjunction with any other vouchers – strict limit of one voucher per order. For vouchers towards WineMarket products issued through one of our partners the customer must still provide valid credit card details to WineMarket to measure against fraudulent activity and provide verification of age. 

Prices: Prices stated are in Australian dollars, and may be per bottle or per case, as stated. Prices include GST, unless otherwise stated. All delivery charges are extra, and not included in stated prices.

Payment: A buyer must pay for an order by Visa or MasterCard when ordering. If the credit card issuer does not authorise the transaction, or later revokes authorisation for the transaction, WineMarket may cancel the order.

Best price policy: If within 30 days after purchasing wine via the website, the buyer finds the same wine for sale anywhere in Australia at a cheaper unconditional price (before delivery charges) and notifies WineMarket of the trade advertisement or reasonable details of where and when the buyer saw the wine advertised at a cheaper price, WineMarket will refund the difference to the buyer.

Prices for Northern Territory: If you are a Northern Territory resident or ordering this for delivery to the Northern Territory the listing of a product on our site does not constitute an offer to sell that product to you. Prior to any offer or acceptance, additional price checks will be completed and the price of the product may increase to ensure compliance with the Northern Territory Minimum Unit Price Legislation. This may change the final price calculation for your order.

Pricing errors: If a product inadvertently appears on the website at the wrong price, WineMarket may decline or cancel any orders placed at the wrong price, even if the order has been confirmed and a credit card charged. If a credit card was charged for the purchase and the order is so cancelled, WineMarket will notify the buyer and issue a credit to the credit card account in the amount of the wrong price.

Product availability: All product is offered for sale on the basis of while stocks last. If a product is out of stock, WineMarket may substitute wines of at least equal quality. The "Customer Promise" (see later) covers all wines supplied, so if the substituted wine is not acceptable, the buyer need not pay for that wine.

Delivery: There are a few tiny corners of OZ we can’t get to — any island smaller than Tassie is a bit of an issue, we don’t deliver to dry communities and we don't deliver to PO Boxes — but if you're anywhere else, we (and your wine) will find you.
Please note: “case” refers to a single bottle, 6 bottle or 12 bottle case, carton or package.

WineMarket endeavour to deliver wine to Australian capital city metropolitan areas within 7-10 working days. For delivery addresses in Australian regional centers and outside metropolitan capital cities, allow at least 14 working days. In outlying areas, delivery will be may take a little longer. WineMarket, do not however guarantee any specific delivery date or delivery to your door in remote areas.

Wine is normally delivered Monday to Friday 9.00 am to 5.00 pm and to either business premises or a residence.

Delivery to South Australia: If you are ordering products for delivery to South Australia, you agree that: (a) on delivery, the recipient of delivery will be required to (i) sign a declaration confirming their name and that they are over 18 years of age, and (ii) if the recipient looks under 25 (at our discretion), provide proof of ID (including photographic identification and date of birth) and the name and date of birth of the recipient will be recorded; and (b) we are instructed to deliver the products to a person at the delivery address provided they are aged 18 years or over and are not intoxicated. Information collected and recorded under this clause will be held for a minimum of 12 months. These are requirements of South Australia's Liquor Licensing Legislation and will apply from 1 July 2019, and if the recipient is unable to comply, we will not be able to complete the delivery. This does not apply to deliveries where you have specifically instructed us to leave the order at the delivery address.

Breakages: If a case of wine is received with one or more broken bottles, WineMarket will issue a credit or send replacement bottles if the buyer so notifies WineMarket within 30 days of the date of the invoice.

Risk: Risk of damage, loss or deterioration to product passes to the buyer on delivery.

Title: Product remains WineMarket's property until paid for by the buyer.

Customer Promise: A buyer of wine via the website who does not like a particular bottle supplied (within 6 months of the sale) need only notify WineMarket as soon as possible to obtain a refund of the price of that bottle. WineMarket will then advise if the wine is also to be collected from the buyer.

If a case of wine was purchased, and the buyer has only opened two bottles (out of a dozen) or one bottle (out of a six-pack) and not liked it, they need only notify WineMarket and be able to make the remaining bottles available for collection (unopened and in original saleable condition) to obtain a refund of the price of the whole case.

If WineMarket reasonably believe that a buyer has breached these terms and conditions, or has abused the Customer Promise, WineMarket may suspend or cancel the Customer Promise in relation to that buyer, cancel a particular order made by the buyer or close that buyer's account.

Cancellations: A buyer may for any reason cancel their order at any time up to 7 working days after the date the wine is received by so notifying WineMarket and provided the bottles are unopened and in original saleable condition.

Returns: Where wine is to be returned, WineMarket will collect the wine from the buyer at a mutually convenient time. Pending collection, the buyer is liable to keep the wine in a safe and proper manner and take reasonable care of it. Wine should be returned in the original box and packed to avoid breakage in transit back to WineMarket.

Refunds: Any price refunds will be effected within 30 days after WineMarket was notified of the reason, conditional upon any returned wine being collected in original saleable condition. Freight charge will not be refunded.

Consumer guarantees:   Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Notices to WineMarket: To notify WineMarket, call on 1300BUYWINE (1300 289946) during 9 am-5 pm EST Monday to Friday, excluding public holidays) or email to enquiries@winemarket.com.au or post a letter to "WineMarket, PO Box 345, Angaston SA 5353."

Notices to visitors: WineMarket may notify a visitor to the website by email, a general notice on the website, or by other reliable method to an address previously provided to WineMarket by the visitor.

Governing laws: The laws in South Australia govern the use of the website and the supply of products.

Force majeure: WineMarket is excused from performing its supply obligations where and so long as prevented from doing so by reason of events beyond its reasonable control. WineMarket will endeavour to notify the buyer of the delay and its expected duration. If so prevented for longer than a reasonable time, WineMarket may elect to cancel the order without liability to the buyer.

Vouchers: If WineMarket issue a buyer a voucher to redeem against the future purchase of wine, the terms and conditions on that voucher apply and bind the holder of the voucher. Vouchers are non-transferable and may not be redeemed for cash.

Warning: WineMarket recommends that alcohol only be consumed in moderation. A case of wine is heavy, so extra care should be taken when lifting it. If you are concerned about the weight, transfer bottles 1 or 2 at a time. Red wine in particular may cause staining if spilt.
